CONSTRUCTION LAW

MEDIATION

PROVIDING MEDIATION SERVICES PROFESSIONALLY, TIMELY, AND EFFECTIVELY ON A COST-EFFICIENT BASIS

In quoting Abraham Lincoln, the ADR Institute of Ontario states that when it comes to disputes, the “nominal winner is often a real loser – in fees, expenses and waste of time.”

There are, of course, the financial costs – even for the winner, which never covers your entire expenses. Even in the most favorable cases there is still a significant out-of-pocket expense to consider.  A recovery of 100% of your legal costs is extremely rare.

However, and for many involved in litigation that goes before the Courts, there is a higher cost. Anyone who has had to deal with a Court action will tell you that the level of stress and time demands are a significant distraction from both their business and personal lives. The human, emotional, and physical toll often far exceeds the financial costs of litigation.  This is a hidden cost that many people do not consider.

As a result, an experienced and skilled lawyer will seek to minimize these “hidden” expenses. The best way to achieve this outcome can be through a resolution of disputes through mediation.

Ian’s rates are $1,950 for a half day ( 3 hours ) or a full day ( 6 hours ) at $2,950 plus disbursements and HST.  These rates are for a two party mediation. For each additional party add $150 for a half day and $250 for a full day.  Any hour or part thereof after will be billed at $475 plus HST.  Mediations and Arbitrations normally commence at 10:00 a.m. in the morning or 2:00 p.m. in the afternoon but Ian can be flexible with the start time.

MORTGAGE ENFORCEMENT

MBC represents the interests of lenders across the Province of Ontario to enforce their security against defaulting borrowers. Our experience means that we can offer our clients the efficiency and attentiveness that is needed to ensure the highest possible recovery for our clients.

We assist our clients in navigating through the challenging process of enforcing their mortgage.  Our lawyers are experienced in both foreclosure and power of sale proceedings, the latter being the more common route.  We ensure that a Notice of Sale is issued so that is has the proper legal effect and can commence Court proceedings to obtain possession of a property.  We thereafter assist our clients in taking possession of the property with a view to satisfying the debt.

We also understand that there are times when a negotiated resolution may be the best way forward, and our lawyers assist our clients in coming to terms that will allow the orderly payment by the borrower, while at the same time not putting our clients’ interests at risk.

REAL ESTATE

Particularly, agreements of purchase and sale from builders are lengthier than a standard agreement and require attention, especially in understanding Tarion’s critical dates.
  • Condominiums – We can provide legal representation in the purchase or the sale of a condominium property. If you are a purchaser, we will help you with the review of the status certificate and all related documents.
  • Refinancing and debt consolidation— If you are refinancing your property to pay lower interest rates or looking to consolidate several debts, we have the experience to close these types of transactions and deal with lenders and judgment creditors.

Our Restructuring and Insolvency Group represents both debtors and creditors, giving us unique insight into the mindsets of both sides and the ability to develop innovative, tailored and practical solutions.

Our Restructuring and Insolvency Group is led by J. Alden Christian. Alden is a seasoned commercial lawyer with extensive experience in bankruptcy and insolvency matters.

The Restructuring and Insolvency Group has celebrated many successes in developing and implementing successful workout plans and restructurings for individuals and corporations. Our restructuring and insolvency lawyers have represented some of Canada’s chartered banks, trustees in bankruptcy, and foreign creditors in Canadian insolvencies.
